INTERNAL COMPLAINTS COMMITTEE


1.      PREAMBLE

 

The committee is formulated with an aim toprovide safe and healthy working environment for women and students.

 

Reference:

 

1) Maharashtra state commission for women, regulation 2015 on 2ndMay 2016

2) Vishakha guidelines by honorable supreme court of India 

 

In exercise of the powers conferred by sub-section (3) of section 1 of the sexual harassment of woman at workplace (prevention, prohibition and redressal)Act, 2013, the central government hereby appoints the 9thday of December,2013 as the date on which provisions of the said act shall come into force.

 

2. AIMS AND OBJECTIVES

·         To receive complaints of sexual harassment from establishment.

·         Provide safe working environment at the workplace which shall include safety from the persons coming into contact at workplace

5. WORKING OF COMMITTEE:

1.      Any aggrieved woman may make in writing a complaint of sexual harassment at work place to the internal committee within three months from the date of Incidence.

2.      When such complaint cannot be made in writing the preceding officer or any member of the internal complaint committee, shall render all reasonable assistance to the woman for making the complaint in writing.

3.      Internal complaintcommittee for the reasons to be recorded in writing ,extend the time limit not extending three months if it is satisfied that the circumstances were such  which prevented  the woman from filling a complaint within the said period

4.      Where aggrieved woman is unable to make complaint her legal heir can make a complaint under this section.

5.      The internal committee before initiating an inquiry under section II and at the request of the aggrieved woman takes steps to settle the matter between her and the respondent through conciliation.

6.      Subject to provisions of section 10, the committee proceeds to make enquiry into the complaint forward the complaint to police within a period of 7 days from registering the care under section 509 of Indian Penal Code.

7.      Internal Committee has process to make inquiry under subsection (I).

8.      If internal complaintCommittee arrives at a conclusion that aggrieved woman made misleading documentation should be taken.

 

6. Duties and Responsibilities of the committee:

 

1.      The committee will be taking care of women’s protection. Regular meeting of Chairman with the committee members regarding the protection of women’s and Students in the college.

2.      Presence of all committee members for meeting is compulsory.

3.      To make provisions against protection against harassment of women at the workplace.

4.      Any of the committee members can receive complains from students or women.

5.      Committee member is duly responsible for the working of committee. 

6.      Reporting the functioning of the committee to the Principal.

 

7. Reporting of the committee:

The committee will report its decisions, suggestions, finding to the concern person /staff and  to the college authorities immediately after meeting.
